Finally, after al that time with the cell phone providers painting the United State landscape with towers the United State Department of Natural Resources and the Federal Communication Commission (FCC) has finally reaches a bartering agreement with AT&T, Alltel, Sprint, and Verizon.  According to Associated Press Coop the internet is finally open.

It seems that the cell phone towers, although on private property or commercial property owned by companies the companies did not pay for the airwaves.  These airwaves are only used by their subscriber but the airwaves are going through personal property, homes and other business without compensation.  This is a violation of airwaves, just because it doesn’t make a sound doesn’t mean it’s not there.

According to FCC/CP Director Gunderson, ” . . . land use is one thing, but using non subscribers and their property as conduits for profit is another. It is like building a highway right through your living room and you still have to live there. Information highway is still a highway and tax payers have rights.”

The airwaves being used by cell phone towers have no legal right to impose that service on the public without prior consent. The options, given by the FCC to the cell phone providers are :

  • 100% Consent from all resident within the range of each cell phone tower. 
  • Remove Towers or limit range.
  • Allow access to all cell towers to everyone between 700 mhz and 950 mhz

So, when will it come into affect?  Well immediately it is a little complicated to access Wifi via cellphone towers. There is a hack at Lifehacker.com (read more . . . ).

The speed is a little slow, but I am sure that the hackers will find a way to speed it up.  So don’t throw away your cell phone, we need you so I can keep free wifi.
